1. These terms and conditions and the www.fiat.co.uk website terms and conditions apply to on-line purchases made using this site. Please read them carefully. They do not affect your statutory rights.

2. References to "we" or "us" are to be read as references to Fiat Group Automobiles UK Ltd of 240 Bath Road Slough SL1 4 DX. Our company registration number is 0201514 and our VAT number is 578353209 Please visit our website to find information about us. References to “you” or “your” refer to the person making the on-line purchase and whose details have been provided in the “Your Personal’s Details” page in the Fiat 500 Pink section of the www.fiat.co.uk website.

3. We may change these terms and conditions at any time. Any changes will take effect on the date they are posted onto the site. Such changes will not affect an order previously accepted by Fiat.

4. By making an on-line order, you warrant that:
a) you are legally capable of entering into binding contracts; and
b) you are at least 18 years old.

5. Prior to placing an order, you will be asked to confirm that you agree to these terms and conditions. Access to this file is available on request. To access the service you will need a computer, internet connection, software necessary to browse the internet and access e-mails, and access to a printer in order to print your documentation. Any agreement to purchase a vehicle on-line using this site will be in English.

6. Before making your on-line order (by using the “buy now” button), you will have an opportunity to check and correct any input errors.

7. By placing an on-line order, you will be offering to purchase your chosen vehicle at the price indicated on our website. After you submit an on-line order, we will give you a reservation reference number and confirm details of your order in an e-mail.

8. Upon our acceptance of your order, a legally binding contract for the sale of the vehicle will arise and you will be obliged to pay the price of the vehicle less the deposit paid.

9. We are unable to accept part exchange vehicles or payments via third party finance companies.

10. We expect to deliver your vehicle approximately seven weeks following confirmation of your order. Although we will endeavour to deliver in this time frame, this time is dependent upon your returning a signed registration certificate and receipt by us of the vehicle’s insurance certificate. Time is not of the essence.

11. We will notify you when the vehicle is ready for registration, at which point payment of the price less any deposit paid will be due within seven days.

12. The price of the vehicle is set out in the order form and is inclusive of on the road charges and vehicle excise duty.

13. You agree to insure the vehicle, to provide insurance documentation to Fiat or its agents when requested to do so and you authorise Fiat to register the vehicle on your behalf. In order for us to register the vehicle, you must send us a signed registration certificate and insurance documents. It is your responsibility to ensure that these documents are received by us.

14. We will contact you about delivery of the vehicle, following receipt of your payment and registration of the vehicle. We will arrange with you a suitable date for delivery (Monday – Friday) and a delivery location. You agree to accept delivery of the vehicle on the date and at the location arranged. This may be at your home or place of work and you must be present on the delivery date. You will require photographic ID in the form of a passport or new style driving licence. Once we have delivered the vehicle to the delivery location it will be at your risk.

15. If you do not pay for the vehicle when required to do so or cancel this agreement (other than in accordance with paragraph 19), we shall be entitled to keep your deposit, to sell the vehicle and to recover the difference between the price at which we sold the vehicle to you and the price at which it was sold.

16. Title will remain with Fiat and we shall not be obliged to release your vehicle until payment has been received in full (cleared funds).

17. Payment must be made in Sterling and may be made by Visa, Master Card, Amex, Switch Solo, or Visa Delta.

18. Your payment details will be passed to our bank by our payment processor, Data Cash Ltd. On receipt, our bank will validate your data and a confirmation message will be sent automatically to you.

19. If you exercise any statutory right of cancellation which you have under Regulation 10 of the Consumer Protection (Distance Selling ) Regulations 2000 and the vehicle has been delivered to you prior to our receipt of the cancellation notice, you must:
a) retain possession of the vehicle and take reasonable care of it when it is in your possession; and
b) return the vehicle to a dealer designated by Fiat at your own cost or, if you do not return it, you must make the vehicle available for collection by Fiat at your own premises and pay the costs which we incur in collecting it.

20. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will process the refund due to you as soon as possible and, usually, within 30 days of the day we receive your cancellation.

21. We reserve the right to cancel or return your order if for technical or other reasons beyond our control, we are unable to supply your vehicle. In the unlikely event that we cancel your order, we will return your deposit and any other payment made at no cost to you.

22. Your vehicle will be supplied with a 24 month manufacturer’s warranty and a third year dealer warranty.

23. We hope that you will not need to complain but should you need to, you can write to Fiat Customer Relations Department, Fiat House, 240 Bath Road , Slough SL1 4DX. We also subscribe to the conciliation and arbitration service under the Motor Industry Code of Practice operated by the SMMT.

24. Your personal data will be held in accordance with our Privacy Policy.

25. When deciding whether or not to accept your order we may use certain information about you, including any information received from credit reference agency checks. In particular, we may pass your details to credit reference agencies for them to check against certain public and private databases. They may keep a record to use in future security checks. This helps to protect you and us against fraudulent transactions.

26. Our site uses industry-standard Secure Sockets Layer (SSL) technology to provide encryption of personal information such as your name, address, and credit card details. In this way, information passed between your computer and our website cannot be read in the unlikely event of someone intercepting it.

28. Our acceptance of your order together with these terms conditions and the Fiat website terms and conditions constitutes the whole agreement between us and supersedes all previous agreements relating to the subject matter of your order. You acknowledge that in entering into this agreement, you have not relied on, and shall have no right or remedy in respect of, any statement, representation, assurance or warranty (whether made negligently or innocently) other than as expressly set out in out in this agreement. Nothing in this clause shall limit or exclude liability for fraud.
